The Gujarat High Court has issued a notice to the Bar Council of India (BCI) in response to a petition filed by a candidate who failed in the All India Bar Examination. Urvi Acharya, an LLM degree holder in Criminal law, filed the case and appeared for AIBE 19. BCI had conducted the AIBE 19 exam on December 22, 2025. The AIBE 19 result, as per the final answer key, was published on March 21, 2025. Read on to get complete details of the AIBE High Court case.
Candidates are required to obtain the minimum passing marks to clear AIBE, which is 45% for general and OBC candidates, and 40% in case of SC/ST candidates. The successful candidates are awarded a Certificate of Practice, which is a necessary document for practising law in India.
The petitioner, Urvi Acharya, alleges that BCI lacks transparency as it has failed to provide any justification for her failure in the bar exam. After the petitioner failed in the AIBE result, she had applied for the OMR sheet rechecking process to get her results verified again. However, upon rechecking the OMR sheet, BCI informed that she has failed to clear the exam. This prompted the candidate to file the petition. BCI is yet to respond to the notice issued to it by the Gujarat HC.
The counsel for the petitioner, Pratik Jasani, argued that the petitioner was a bright student with a first-class in LLM. He further argued that seven questions were withdrawn in the AIBE final answer key, which brought the total marks to 93 instead of 100. The passing marks were accordingly revised to 42 marks instead of 45 marks (for general/OBC candidates). He said, BCI ought to have awarded grace marks to the candidate.
AIBE had declared the AIBE 19 result on March 21, 2025, as per the revised answer key. It also allowed candidates to apply for verification of the OMR sheet if they were not satisfied with the result. The application for rechecking the OMR sheet was open between April 1 to April 10, 2025. Such candidates were then informed about their revised AIBE 19 result on their registered email IDs. BCI has also published a notification in this regard on its website.
